Terms of Use
These terms govern your access to and use of Awarely, including our website, AI video creation tools, and credit-based services.
Last updated: October 2026Contents
1. Acceptance of These Terms
By creating an account on Awarely ("Awarely", "we", "us", "our"), accessing our website, or using any of our services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the services.
By registering, you confirm that you have read, understood, and accepted these terms and the Privacy Policy, and that you are at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher).
2. Your Account
You must provide accurate and complete information when creating an account and keep your credentials confidential. You are responsible for all activity that occurs under your account.
Notify us immediately at info@awarely-motion.com if you believe your account has been compromised. We may suspend or terminate accounts that provide false information, violate these terms, or pose a security risk.
3. Credits, Payments & Refunds
Awarely uses a prepaid credit system. Credits are purchased in packages through our payment providers (PayPal, Stripe, and Binance Pay) and are consumed as you use the service (e.g., per second of rendered video). One (1) credit equals one (1) second of standard video output.
- Credits have no cash value and are non-transferable.
- Purchased credits do not expire, subject to the retention policy of your plan for the underlying media files.
- New accounts receive a one-time grant of free credits, which may be changed or withdrawn at any time.
- All purchases are final except where required by applicable law or where a refund is expressly granted by us at our discretion (for example, a duplicate or erroneous charge). To request a refund review, contact info@awarely-motion.com within 14 days of the purchase.
- We may suspend credit granting if a payment is reversed, charged back, or found to be fraudulent.
Prices, credit packages, and feature availability may change at any time. Changes do not affect credits you have already purchased.
4. Coupons, Promotions & Affiliate Program
We may offer discount codes, promotional credits, and an affiliate program through which marketers earn commission on referred purchases.
- Coupon codes are single-purpose, may expire, and cannot be combined unless stated.
- Affiliate commissions are calculated on the discounted amount according to the active coupon policy and are subject to our fraud and refund rules.
- Manipulating coupons, self-referring, or spamming referral links will result in removal from the program and forfeiture of unpaid earnings.
5. Acceptable Use
You agree not to use Awarely to:
- Create content that is unlawful, hateful, harassing, defamatory, or obscene.
- Impersonate any person or entity, or deceive others into thinking output was produced by or endorsed by a real person or brand without permission.
- Generate deceptive media intended to defraud (e.g., fake endorsements, phishing, non-consensual deepfakes of private individuals, or misinformation presented as fact).
- Infringe intellectual property, publicity, or privacy rights of others.
- Attempt to reverse engineer, scrape, overload, or disrupt the service.
- Resell, sublicense, or commercially exploit output in violation of these terms.
- Circumvent credit metering, authentication, or rate limits.
We may monitor usage to the extent permitted by law and take action — including content removal and account termination — for violations of this section.
6. Your Content & AI Output
You retain ownership of the prompts, materials, and assets you provide ("User Content") and of the videos, images, and other outputs generated for you ("Output"), to the extent permitted by law.
You grant Awarely a limited, non-exclusive license to host, process, and display User Content solely to operate and improve the service (for example, rendering your videos on our workers). You are solely responsible for User Content and Output, including ensuring you have the rights to any material you upload and that Output complies with these terms.
AI Output may be similar to output generated for other users and is provided without guarantees of uniqueness or suitability for a particular purpose.
7. Intellectual Property
Awarely, including its software, templates, designs, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These terms do not transfer any ownership rights to you. You may not copy, modify, distribute, or create derivative works from our platform except as expressly permitted.
Feedback you provide may be used to improve the service without obligation to you.
8. Suspension & Termination
You may stop using Awarely and request account deletion at any time by contacting info@awarely-motion.com.
We may suspend or terminate your access if you breach these terms, if required by law, or to protect the service and its users. Where reasonable, we will provide notice. On termination, your right to use the service ends; provisions that by their nature should survive (such as ownership, disclaimers, and liability limitations) survive termination.
9. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that Output will meet your requirements.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Awarely and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of the service.
Our aggregate liability for any claim arising out of these terms will not exceed the amount you paid to us in the 12 months before the claim arose, or CAD $100, whichever is greater. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
11. Changes to These Terms
We may update these terms from time to time. If a change is material, we will notify registered users by email or through the service at least 15 days before it takes effect. Continued use of Awarely after the effective date constitutes acceptance of the updated terms. If you do not agree, stop using the service and close your account.
12. Governing Law
These terms are governed by the laws of Canada, without regard to conflict-of-law rules. Any disputes will be subject to the exclusive jurisdiction of the courts competent in the province in which our principal operations are located, unless applicable consumer law provides otherwise.
